BREAKING Ripple V SEC: Judge Rules Hinman Docs CANNOT Be Sealed!

Judge Analisa Torres delivered a victory to Ripple, on Wednesday, by ruling that the Hinman docs can’t be sealed.

The SEC filed a motion on Dec 22. 2022 to keep the Hinman documents sealed from the public under the guise of ‘deliberative privilege’—today the judge denied that motion.

Previously, Judge Torres overruled a motion by the SEC to keep the Hinman documents out of the courtroom altogether.

It remains to be seen what effect this will have, if any, on XRP’s price.

We will bring you more information on the infamous Hinman documents as they become available to us, for now, here’s what we currently know:

CoinDesk quoted Judge Torres:

“As Judge Netburn found in her order dated January 13, 2022, the Hinman Speech Documents are not protected by the deliberative process privilege because they do not relate to an agency position, decision, or policy,” Torres wrote.

“Therefore, sealing these documents would not be related to preserving ‘openness and candor’ within the agency, nor would such an interest be substantial enough to outweigh the strong presumption of public access.”

 

Coin Telegraph clarified:

While the court has ruled the Hinman Speech documents will be made public, it has granted the other two requests from the SEC that asked for the redaction of names and identifying information of SEC experts and XRP (XRP) investor declarants, as well as personal and financial information of the defendants.
