Terraform Labs co-founder, Do Kwon has once again managed to sidestep extradition to South Korea or the United States.

A Montenegrin court has ruled that technical improprieties at the lower court level mean that Do Kwon cannot be legally extradited to either of the aforementioned countries where he is facing investigation. Daily Coin explained:

Criminal Procedure Rules Article 386, item 8 states that criminal proceedings are substantively violated if the judgment is incomprehensible or contradictory, while item 9 clarifies that judgments must be made on clear, decisive facts.

Complicating matters further, the Appellant Court also deemed that established extradition procedures under the International Legal Assistance in Criminal Matters law were disregarded.

Previously, ProCoin News reported that Kwon was engaged in a legal back and forth with the courts regarding his extradition. The decision has been reversed several times now.

This comes at the same time that former Terraform Labs CFO Han Chang-joon was extradited to South Korea to face charges of fraudulent marketing.

At this point, it is unclear how this will affect the Terraform Labs co-founder’s charges and ongoing investigation in the United States. The crypto community reacted with shock, disbelief, and a bit of humor:

CoinDesk reminded readers:

He was arrested in Montenegro last year for possession of falsified official documents and sentenced to four months in prison. While Kwon is serving his sentence, Montenegrin authorities must approve his extradition and decide the destination.
